While many Southern California and San Diego personal injury attorneys regularly insist upon a fee in excess of one-third or employ a sliding scale fee structure such that the fees increase as the case progresses, we prefer to simplify the process. In most personal injury cases, we accept the representation for a straight 1/3 contingency fee, which remains the same even if we proceed through trial. Additionally, we regularly advance costs and, in accordance with the California Rules of Professional Conduct, typically agree that our recovery of such costs will be contingent upon our ability to secure a monetary recovery in the accident or personal injury case. By proceeding in this fashion, our clients are not burdened with the expense of litigation and we are compensated and reimbursed for costs only upon the favorable resolution of the case.
